CZECH REPUBLIC: REPRODUCTION ASSISTED WITH DONORS

The country neither legalizes, nor regulates, nor prohibits couples to apply and perform surrogacy treatments. Based on these principles, Global Surrogacy Ltd. has developed, with the collaboration of local clinics and jurists, a secure Third Party Assisted Reproduction protocol in the Czech Republic combined with a surrogacy contract with Ukrainian carrier, in order to offer another viable and safe alternative within the framework of “Cross Border Surrogacy”. Legislation:

The Law nº 373/2011 on Specific Medical Services establishes that a woman can perform an artificial fertilization using gametes donated by anonymous donor. An anonymous donor can only be a woman over 18 and under 35. The donor must not be a person with legal capacity or restricted legal capacity.

The egg donation is anonymous, voluntary and free in the Czech Republic. Our donors are young women under 34 who meet the criteria determined by Czech legislation, the European Tissue Directive and strict criteria and guidelines on oocyte donation from the American Society for Reproductive Medicine, published in the journal Fertility and Sterility , vol.77, n. 6, suppl.5, June 2002.

In advance all donors are subjected to strict gynecological, endocrinological and genetic tests. They are also repeatedly tested to check for sexually transmitted diseases (HIV, syphilis, hepatitis, chlamydia, cytomegalovirus). Only the donors who pass all these tests are included in our database.

The Conference aimed at the Legalization of Alternative Methods for Human Reproduction, that is, the cases that require a Surrogacy solution, was held on June 5, 2009, in the city of Konopiste, Czech Republic.

As agreed among the experts explicitly, these methods can be used only according to specific medical indications (such as damage or agenesis of the uterus, heart disease, etc., since any of such diseases could pose a threat to the health of a pregnant mother, the fetus or both) but not for the benefit of women who use it as a resource for any social reason: lack of will to end their career, fear of childbirth, etc.

The ethical dilemmas in relation to the issue of Surrogacy in the Czech Republic create a space to legislate and to try to find a solution that allows avoiding all the risks and highlighting a series of positive aspects on the other side.

The Czech legislation is trying to find this solution and although there are few proven children born by surrogacy in the Czech Republic, the whole process of surrogacy still continues in a legal vacuum for the time being.

The only obstacle to the application of this method of Reproductive Medicine is that there are still laws approved in the Czech Republic that regulate the legal aspects of surrogacy pregnancy.

This alternative is  for married heterosexual couples  who wish to perform  IVF with their own genetic material  in the Czech Republic Clinic + embryo transfer in the Czech Republic to a Ukrainian pregnant woman, who then returns to Ukraine to carry the pregnancy until the  birth of the baby in Kiev, Ukraine.

2) “Czech Republic IVF + Egg Donation + Birth in Kiev”  U$S 60.000 

This alternative is  for married heterosexual couples  who wish to perform  IVF with an egg donor , in the Clinic of the Czech Republic + embryo transfer in the Czech Republic to a Ukrainian pregnant woman, who then returns to Ukraine to carry the pregnancy to the  birth of the baby in Kiev, Ukraine.

3) “Czech Republic IVF + Egg Donation + Birth in Prague”   U$S 64.000 

This alternative is  for single men and gay couples,  who need  IVF with an egg donor , in the Clinic of the Czech Republic + embryo transfer in the Czech Republic to a Ukrainian pregnant woman, who then returns to Ukraine to carry the pregnancy until month 7, when she returns to  Czech Republic to settle there until the date of birth of the baby in Prague.

4) “Czech Republic Frozen Embryos + Birth in Kiev” U$S 54.000

This alternative is  for married heterosexual couples who already have vitrified embryos in their local clinic and wish to send them to the Czech Republic to carry out the embryo transfer there to a Ukrainian pregnant woman, who then returns to Ukraine to carry the pregnancy until the  birth of the baby in Kiev, Ukraine.
